Justice Subhra Kamal Mukherjee and Justice Kalidas Mukherjee passed the order on behalf of the High Court in Calcutta, under whose jurisdiction the Kalyani University falls. All the 39 staff members were from the districts of Barrackpore, Kalyani and Murshidabad, and were appointed to the university after their names featured on the list submitted by the employment exchanges in the respective districts.
Whereas these 39 men started work at the Kalyani University, a certain person by the name of Shayamal Pramanik started all the problems when he challenged the procedures involved in the appointments made by the university. It was then that the 39 non teaching staff were removed from office. The complaint was lodged in the year 2004 and the court took the decision to get the 39 members removed in the year 2005. Justice Pratap Kumar Roy was the sitting judge who ordered the withdrawal of the 39 non teaching staff from the University. In spite of all the staff members and the representatives of the Kalyani University protesting against the decision taken by the Justice Pratap Kumar Roy, no favorable result could be achieved in 2005. From 2005 to 2007, the order had been challenged in court but in vain. This condition forced the university authorities to sack all the 39 non teaching members in August 2007.
