Judge tosses charter school case against state

BOISE, Idaho — A federal judge has dismissed a lawsuit filed against the state of Idaho by a charter school that planned to use the Bible as an instructional text.

The Idaho Press Tribune reports that U.S. District Judge Edward Lodge dismissed the case Monday filed by the Nampa Classical Academy.

The school, which opened last year, sued the state and the Idaho Public Charter School Commission in September after the commission barred it from using the Bible as an instructional text.

The judge ruled the commission did not violate the school’s rights, but acted appropriately under the U.S. Constitution.

Charter school founder Mike Moffett says no decision has been made whether to appeal.
